Berg\, of the Law Office of Robert J. Berg\, is an experienced litigator\, who has\, for the past 38 years\, specialized in complex class action litigation in the federal and state courts nationwide.  Mr. Berg has been a lead or co-lead counsel for plaintiffs in numerous securities fraud and consumer fraud class actions\, and he has achieved hundreds of millions of dollars in recoveries for class members.  Mr. Berg graduated from Amherst College\, with a B.A. degree cum laude.  He received his J.D. degree from the University of Chicago Law School and his M.B.A. degree from the University of Chicago Booth School of Business. In recent years\, Mr. Berg has developed a specialty in advising individuals and organizations regarding the deployment of wireless telecommunications facilities in their communities. DESCRIPTION:The Residents of Boyle Heights Do Not Want Another Exide\n\nResidents of Boyle Heights will be holding a hunger strike and protest at La Casa del Mexicano (East 6th Street and S. Evergreen Avenue\, Los Angeles\, CA 90023) on Sunday\, May 16th starting at 8AM.\nCommunity members are protesting being locked out of their community garden and playground by Verizon Communications and East LA Community Corporation (ELACC).  \n\n\n\nAlthough ELACC sold space to Verizon for the construction of a 5G Tower\, the contract was approved during disgraced LA City Councilman José Huizar’s time in office. Now that Huizar is charged in a 41-count racketeering indictment\, alleging he accepted $1.5 million in bribes from developers in exchange for his support of building projects\, the residents of Boyle Heights would like a full investigation of this Verizon-ELACC contract. Ultimately\, the community is asking for a resolution or cancellation of this project. It is not understood why the cell tower cannot be built in a more industrial area as is common in wealthier neighborhoods. \n\n\n\nEarlier this week\, residents were met with armed security guards sent by Verizon who called LAPD when they arrived to peacefully protest the loss of their community space. In addition to the trauma of being barred from their beloved community garden and gathering space with weapons\, residents also fear the radiation emissions from the macro tower that Verizon is building on the ELACC property. \n\n\n\nWhile it is understood that the harmful side-effects of such a project are still being researched\, the community still fears increased cases of asthma and cancer among children and elders. The same groups that are still battling ramifications from the Exide lead leak in Boyle Heights\, once called a Chernobyl-level event. \n\n\n\nThis protest comes after the residents of Boyle Heights have unsuccessfully asked for help from elected officials in City Council\, Assembly\, Senate and Congress. Unfortunately\, no one has agreed to meet with the worried residents of Boyle Heights. The community feels abandoned by their own representatives and fear they will have to face environmental racism once again as with the Exide Plant and freeway being built through the streets of this neighborhood.  \n\n\n\nBrenda Martinez\, the Boyle Heights community member who is leading this hunger strike\, along with residents who are joining her in protest\, are doing so to seek the support of their elected officials. \n\n\n\nPlease help the residents of Boyle Heights raise awareness of this environmental and social injustice. On November 20\, 2020\, the US Court of Appeals of the DC Circuit granted the request for oral arguments and scheduled the hearing in our case for January 25\, 2021 at 9:30 am.\n  \n\n\n\nLikely\, a few other cases will be scheduled for the same day and time and therefore\, the exact time our hearing will start is unknown.\n\n\n\n  \n\n\n\nDue to Covid\, the hearing will not be in person but via video conferencing and will be live-streamed.\n\nThe Court ordered that only one attorney will be able to speak for all the Petitioners\, and it was a joint decision by CHD\, EHT and EHT’s attorney\, Ed Meyers\, that CHD’s attorney\, Scott McCollough will give the argument. \n\n\n\nThe Oral Arguments will be by video but only the judges and the attorneys who are presenting will be part of the zoom. DESCRIPTION:5G Free California Monthly Zoom Meeting: \nThursday\, June 9th\, 6 pm Pacific Time\n \nThis month\, we are moving our meeting to the 2nd Thursday because of the Fourth of July weekend. \nThe theme of this month’s Zoom meeting is Lessons from Local Municipalities Winning the Battle to Halt 5G and Other Wireless Infrastructure Roll-outs.\n \nScheduled presenters include:\n \n\nPaska Ann of Easton\, Connecticut\, who was successful in getting her town to pass a moratorium to stop the 5G roll-out until health and safety studies have been completed.\nKelly Marcotulli of Ashland\, Oregon\, who formed Oregon for Safer Technology and recently defeated a planned AT&T 105-foot mono-pine cell tower in the center of town and in close proximity to a pre-school\, an elementary school\, a middle school\, university dorms\, and many residences.\nDebra Greene\, PhD of Keep Your Power\, from Maui\, Hawaii\, who has beat back two towers and has powerful action strategies to share.\nPaul G of Scientists for Wired Tech\, who has successfully supported stopping cell tower installations and upgrades in several San Francisco Bay area communities as well as Hawaii.\n\n\n \n This will be an exciting meeting\, and we hope you can join us on this important call. We will begin with presentations from the four panelists (ten minutes each)\, and then we will open up for taking your questions.\n \nThe format will include callers asking the panelists their questions as well as our moderator reading out questions emailed in advance and sent in via Zoom chat or Facebook comments during the meeting. \n\n To answer as many questions as possible during the call\, we are gathering questions emailed in advance to 5GFreeCalifornia at gmail.com.\n \n\n\n We will begin at 6 pm Pacific Time to accommodate people on the east coast\, and we will have an hour and 20 minutes for answering your questions.\n \n\n\n We will be recording the meeting and making the recording available on BitChute afterwards\, so your choice to speak your question aloud during the meeting is your permission for us to record your voice and publish it on the world wide web.
